No one can really be sure what was happening in the vehicle that could have caused the erratic driving. There are a lot of things that can cause erratic driving (Cell phone use, changing a radio station, day dreaming, even falling asleep at the wheel). If any of these things happen and then the negligent driver suffers a seizure as a result of the accident then the insurance company would be liable. Where does the burden of proof lie?
